Já
tentei por diversas oportunidades demonstrar como resolver os problemas
nacionais, da ordem macroeconômica, envolvendo economias públicas e privadas,
acerto de correção de rumos, com medidas ajustadas à retomada de confianças
externas e interna, sem nunca ter sido chamado a demonstrar como fazê-lo de
maneira científica, parece que as pessoas que administram ficam cegas, por sua
responsabilidade sem atender ou entender que pessoas de fora podem contribuir
de maneira positiva para resolver os problemas com outro campo visual, esgotado
por quem está jogando (administrando).
É
a figura dos assistentes do jogo de xadrez que não podem se intrometer mas
sabem os erros cometidos dos jogadores e como retomar o curso; ocorre, que na
vida real, os assistentes podem e devem se intrometer e demonstrar o que é
certo, até porque a responsabilidade e consequência é de todos.
A
Presidência do Brasil mente em querer fazer pacto nacional, visto que, sequer

Esta
ausência de entendimento, que emana dos administradores públicos, em razão de
conflitos partidários, avança entre cenários e esferas, nos poderes municipais,
estaduais, federal, e poderes legislativo, judiciário e executivo.
Não
há, nem haverá, de quem quer que seja solução sem entendimento real do quadro e
desvendamento dos enigmas que geram sombras que não são devidamente
esclarecidas a todos as pessoas.
O
conflito que reina, leva ao povo acreditar em qualquer notícia, fugindo da
realidade que tem que enfrentar, afirmações do tipo que Lula chegou à conclusão
que seria mais barato comprar senadores em número menor, e, que Dilma foi atrás
de seus alinhados políticos para pegar estes recursos foram ouvidas, e, que, só
servem par tumultuar o País, sendo episódio lamentável.
Particularmente,
acredito que por falta de compreensão do erro, e falta de aceitação, além de
não saber ouvir, Dilma hoje não possui mais as credenciais necessárias para
conduzir a diversidade da unidade que exige o Brasil de hoje e do futuro.
A
administração financeira, nunca foi objeto de interesse da população nacional,
a não ser por quem a administra ou se relaciona diretamente, os que sofrem as consequências,
ouvem sem entender, e, por isto, sem opinar, e, quando opinam, opinam sem o
completo entendimento dos fatos e elementos necessários a forma juízo perfeito.
Toda
e qualquer solução passa pela composição, análise e julgamento de todos os
elementos envolvidos, nos aspectos individual e global; ou seja, sem analisar

compromissos financeiros, já em desequilíbrio contábil.
Nesta
mesma conta, ou seja, para obter crédito ou renová-lo, a análise que leva em
consideração a capacidade de endividamento, leva em conta o quanto tem de
receita disponível ou a receber.
Não
tendo o Brasil, honrado seus compromissos internacionais, com garantias
patrimoniais, ao peso de juros compostos, que paga e recebe de seus devedores,
quando o STF passa a inexigir o valor composto, passa a fazer com que os
anunciados 313 bilhões de imediato inexigíveis, se reflitam, por efeitos
cascatas aos recebíveis do governo, expandindo ao longo do tempo pelo mesmo
cálculo dos juros compostos.
Os
mesmos juros compostos, foram discutidos como fórmula injusta por Leonel
Brizola, que foi indevidamente ridicularizado, porque somente por esforço
internacional de nova fórmula de contabilidade da dívida que é injusta, sem
sombra de dúvidas, é que será possível rever este estado de coisas.
Como
é possível entender o depauperamento da contabilidade federal, com as
liminares, colocando em risco o próprio salário dos ministros e servidores do
judiciário federal, em verdadeiro enigma a ser desvendado. Note-se que o
fundamento anterior leva em conta sem alto graus de risco como hoje ocorre, a segurança
financeira nacional, hoje ameaçada, por advento do efeito dominó das liminares
aos estados retirando o componente composto, em liminar sem nenhuma garantia,
de modo a não desequilibrar as contas e prestação de contas, antes do
julgamento de mérito, que ao contrário do afirmado no julgamento das liminares,
requer produção de provas muito mais apurado do foi feito, inclusive,

dos estados, que coniventes com o sistema de medidas de improviso do governo
federal, não enxergaram que é necessário rever por completo o sistema interno
de produção e mecanismos de acesso à justiça de modo que a produção não seja
penalizada com medidas coercitivas injustas e inexistentes em sistemas de
produção mais avançados, tornando o Brasil, cada vez menos competitivo no
cenário internacional.
A
judicialização e direito de indenização de todo e qualquer ato civil banalizou
o judiciário, de forma a torna-lo vítima da incapacidade de lidar com o excesso
de demandas, e, neste contexto, o novo cpc, nem cócegas faz para no curso de o
tempo contribuir para diminuir o excesso de demandas.
O
judiciário Brasileiro é refém de si próprio, porque não atua de forma
preventiva, tanto quanto os demais poderes; a negativa de acesso ao judiciário
pode ser vista em casos como as exigências de fórmulas mágicas para cheios de
preliminares evitar o uso de recursos, que serão compreendidos, preenchidos,
por simples cópia e cola, e, logo, logo, tudo volta como antes, sem solução por
excesso, e, por não compreender que a missão de julgar é possível de agir de

contabilmente o quadro é que está de fato ocorrendo.
A
discussão não é diferente dos famosos juros de 12% ao ano, que não atingiram
contratos financeiros, por julgamento em Brasília, que até hoje, os advogados
que militam contra cálculos de juros indevidos, afirmam em boca miúda que os
bancos pagaram para julgadores, e, o que é pior já se ouve que os bancos
novamente pagariam para o julgamento em seu favor, coisa que particularmente
não acredito.
O
horizonte pode ser tranquilo e favorável, com nova aquilatação dos valores que
compõe a força produtiva, o modo que circula no sistema financeiro, a visão
equilibrada da exceção de acesso à justiça por uso de justiça preventiva, com
uso massificado de controle prévio das instituições de controle, órgãos de
classe, e, sobretudo, retirando da mídia policial indevida, os servidores da
polícia, judiciário e ministério público, que assusta a todos que querem
investir, porque não se sabe no exterior a quem atingirá preferindo evitar o
investimento,
Os
serviços de controle fazendário, policial, de contas, judicial, do ministério público,
prestando serviço de caráter preventivo, realizando seus préstimos nas contas
públicas e privadas, através de emenda constitucional que retira a judicialização
de quem se filiar ao direito de controle prévio devolve aos investidores a confiança
de investimento.
O
controle prévio, associado a garantia securitária, igualmente controlada, com a
associação dos órgãos de classe e de controle, devolverá às forças produtivas a
autoconfiança perdida.
De
nada adianta se filiar a correntes políticas externas de esquerda ou de
direito, se no cenário interno, não há normativo capaz de ser aplicado de forma
confiável.
As
regras bem seguidas, sem exceções, será a demonstração cabal e inequívoca que
os holofotes não mais atenderão programas policialescos que nos mostram cada
dia mais como nação de quinta grandeza que não somos. Em verdade, só precisamos
de ordem, confiança, justiça econômica e social, sem judicialização indevidas,
fiscalização de qualquer ordem funcionando preventivamente, e, deste modo,
devolvendo ao povo Brasileiro, o que realmente ele é, ou seja, povo de
primeira, que pode e deve viver como povo de primeiro mundo, sem exceções, sem
mais enigmas econômicos e jurídicos, porque todos somos capazes de entender e
agir de acordo com a necessidade de sermos a Nação Brasileira, que vive bem e
convive em regime de troca justa de esforços com o restante do mundo, desenvolvendo
a todos de maneira equilibrada e justa.
